2008 OTLA Outstanding Law Clerk Award

The successful candidate will have displayed generosity with their time and contributions in their assistance to their fellow law clerks, and has shown a dedication to those for whom we advocate.
Jose takes great pride in his abilities to assist victims and their families obtain the benefits they so rightly deserve. He helps facilitate and coordinate treatment and health care services with treatment providers, the insurance adjusters and the victims and their families.
Jose has a well known successful track record amongst his peers and within the Financial Services Commission of Ontario as being a competent advocate in the mediation and arbitration process.

Neinstein represents students of Shelter Bay

Neinstein & Associates LLP is representing the students of Corneilus Kersten, a teacher at Shelter Bay Public School in Mississauga, Ontario.
Corneilus Kersten, a teacher at Shelter Bay Public School, is alleged to have sexually assaulted students in his elementary school classroom. Kersten has recently been charged with indecent assault on a male and gross indecency stemming from incidents involving grade school children going back to 1978. He was released on a promise to appear and is set to appear in Court again on April 7, 2008 regarding those charges.

Contaminated Drinking Water

The Washington Post and other American media outlets have revealed a scary story. After a recent investigation by the Associated Press, they indicate that numerous drug particles such as, antibiotics, anti-covulsants, mood stabilizers and sex hormones were found in the drinking supplies of almost 41 million Americans.
The Post articled also stated, "in Canada, a study of 20 Ontario drinking water treatment plants by a national research institute found nine different drugs in water samples. Japanese health officials in December called for human health impact studies after detecting prescription drugs in drinking water at seven different sites."
Although, the presence of these particles is very small the long term effect of consuming them overtime is unknown. The article cited, "recent studies - which have gone virtually unnoticed by the general public - have found alarming effects on human cells and wildlife."
The presence of the particles is attributed to people taking pills. While our body absorbs most of the medication a great deal passes through us and ends up in the toilets which eventually ends up in our water supplies. Despite, today’s modern treatment facilities the medication residue continues to remain in the water supply.
This is a very frightening reality which has gone unnoticed for sometime.

Recall Notice

The U.S. has recalled about 24,000 Indonesian made cribs that were being imported by Munire Furniture Inc. The cribs "have improper brackets that don't allow their mattresses to be fully lowered. This could allow children inside the crib to crawl over the railing and fall."
Among some of the other models included are the company's Majestic Curved Top, Majestic Flat Top, Essex, Brighton/Sussex and Captiva cribs with various model numbers.
Thankfully, no injuries have been reported yet.

So far the Canadian government has not issued any such warning.
Class Action against Dannon in the United States

A Los Angeles law firm has filed a class action with the United States District Court in California against the Dannon Company. In a press release the firm states:
An enormously successful marketing campaign promoting the supposed health benefits of "probiotic" yogurt products such as Activia and DanActive helped The Dannon Company, Inc. ("Dannon" or the "Company") sell hundreds of millions of dollars worth of yogurt in recent years. However, a class action filed today in California revealed that while spending more than $100 million to falsely claim that Activia and DanActive have "clinically" and "scientifically" "proven" health benefits not available in other yogurts, Dannon's own studies flatly disproved the Company's deceptive boasts.
The class action also alleges that because of the deceptive advertising scheme Dannon has been able to charge a 30% premium on the product.
The official Activia website makes no mention of the class action.
